Baby Gender at 16 Weeks: When Can Doctors Tell, What's Legal in India, and What Parents Ask

It is a completely natural curiosity. But in India, this question has a legal dimension that most parents need to understand. This blog covers both the development of your baby at 16 weeks and the important legal context around sex determination in India.

Your baby at 16 weeks: growing fast and full of activity

Can the gender be determined at 16 weeks?

Biologically, yes. The genitals are sufficiently formed by 16 weeks that a skilled sonographer can sometimes identify the sex of the baby on ultrasound. However, accuracy at this stage is not 100% it typically reaches about 95% accuracy by 18-20 weeks.

NIPT (Non-Invasive Prenatal Testing) blood tests, done from week 10 onwards, can identify chromosomal sex with near-100% accuracy but this test is primarily used for chromosomal screening, not just sex identification.

The PCPNDT Act: what every Indian parent must know

In India, revealing the sex of the fetus to parents is illegal under the Pre-Conception and Pre-Natal Diagnostic Techniques (Regulation and Prevention of Misuse) Act — commonly known as the PCPNDT Act 1994, amended in 2003.

Why this law exists: India has historically faced the problem of female foeticide, the selective abortion of female foetuses. Despite progress, India's sex ratio at birth remains skewed in several states. The PCPNDT Act was enacted specifically to prevent sex-selective abortion.

What about families who are simply curious, not planning anything harmful?

This is a fair and honest question. Many Indian families, particularly urban, educated parents are genuinely only curious about their baby's sex for planning, names, and personal reasons, with no intent of harm.

The law, however, does not make exceptions based on intent. The rationale is that sex-selective practices are difficult to verify individually, so the prohibition must be universal to be effective.

Some parents travel abroad (countries like Thailand, Malaysia, and Dubai where it is legal) to have the sex revealed. Some use NIPT reports from abroad. These choices are personal, but the disclosure within India remains illegal.

When can you find out baby gender for medical reasons?

For medical reasons specifically when certain sex-linked genetic conditions are suspected sex determination is permissible under specific legal conditions, with written consent, at registered facilities, and only with documented medical justification. This is not a routine process and must be conducted strictly under PCPNDT guidelines.
